Wedding Photography
BOOKING FORM + CONTRACT
This agreement is between the "Clients" as outlined below and EMILY BRITTAIN DELGADO (17 Barton Hill, Bury St Edmunds, Suffolk, IP31 1SN) hereinafter referred to as the "Photographer"
Entire Agreement
This agreement contains the entire understanding between the Clients and the Photographer.
Confirmation:
A signed “Wedding Photography Booking Form and Contract” and payment of the booking fee are necessary to confirm the stated wedding services from the Photographer on the wedding date provided above.
Pre Wedding Consultation :
To be agreed at a convienent time/date for both client and the Photographer once booking process is completed. The Clients will outline broadly what is required and the Photographer will advise on planning, logistics and timings where needed. If required the Clients are welcome to request any additional meetings closer to the time of the wedding to iron out the remaining details. It is the clients responsibility to ensure the Photographer is made aware of any significant changes to the wedding day at least 28 days before the wedding date. I will also contact you a few days before the wedding to confirm my arrival and any last minute details.
Cooperation:
The Clients and the Photographer consent to cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. If a second photographer has not been requested then the Photographer may require assistance in organising the formal group photos (e.g. from the best man or an usher). The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use their discretion but cannot be held responsible for a lack of photos of these people.
The Schedule:
We know sometimes schedules can go out the window on your wedding day and in extreme cases (when one of the party are running extremely late for example) we may be unable to get the normal set of photos although in such circumstances we will do our absolute best to compensate.
House Rules:
Note the Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the Clients to make themselves aware of the rules of the venue concerned and inform the Photographer of these limitations.
Wedding Guests:
Many of your guests will have digital cameras and they will want to photograph the Clients. If possible it would be beneficial to both parties that the Clients agree to give the Photographers precedence over the guests in order to take the photographs required for the wedding services described above.
Copyright law:
The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives, this includes printing, copying, sending via email or sharing on social media platforms. Sale or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.
Display:
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, venue, and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the client(s). Images placed in password-protected galleries within the website are not available to the general public in the normal course of events.
Liability for digital files:
a) Photographs and footage shall be kept for ONE (1) year from the wedding date at one site.
b) Client(s) are responsible for making back-ups of their media. Should digital media be lost, damaged, or destroyed the photographer holds no responsibility, however, will replace them but only at a cost to the client(s). All media is erased 12 months after the wedding date, copies, prints, or anything else will not be available after this time.
c) If the clients do not choose their images for the album within 6 months of receiving them, the photographer reserves the right to select images and then print the album without the client(s) approval. Only images taken by the photographer will be printed in the album, guests photos will not be included. Any product supplied will be at the sole discretion of the photographer(s) and forwarded to the last known address of the clients.
d) No refunds will be made on products ordered, they are customised to the client(s) request.
Limit of Liability:
If a Photographer is too ill or becomes injured and cannot supply the wedding services specified above the Photographer will try to book a replacement wedding photographer. If a replacement photographer cannot be found then liability is limited to a refund of any payments received. The Photographers have working methods in place to prevent loss or damage to your images, both digital and film (35mm/120mm) However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
Cancellation :
The Client may cancel this contract at any time by giving written notice to the Photographer but in doing so shall forfeit any monies paid. Cancellation less than 28 days before the wedding will result in payment in full becoming due. All cancellations must be in writing.
Deposit/ Remaining balance:
A non refundable 25% deposit is due to secure your date at the point of booking.
Payment of the full remaining balance is due 28 days before the day of the wedding.
